A recent ruling by a German court has the potential to reverberate in the UK, particularly for the significant number of Syrian refugees living here at taxpayers’ expense. This ruling could significantly impact their status and future in the UK.
So far, none of them have been deported, even if they have committed serious crimes. British judges and politicians claim that Syria is a dangerous country. However, a decision made by a German court undermines the case for keeping Syrian refugees in the UK.
In fact, according to a higher court in Germany, conditions in Syria no longer pose a serious threat to human life. Therefore, Syrian criminal offenders can be deported back to their home country.
The Münster Higher Administrative Court in the state of North Rhine-Westphalia ruled that despite the ongoing civil war, some regions in Syria are not generally unsafe.
The court recently rejected the appeal of a Syrian who arrived in Germany in 2014 and applied for subsidiary protection status. Subsidiary protection is for individuals who are not considered refugees under the Geneva Refugee Convention but are still in danger in their home country.
The man was denied refugee status or subsidiary protection status by Germany’s Federal Office for Migration and Refugees because he had been involved in smuggling people from Turkey to Europe before entering Germany. He was sentenced to several years in prison in Austria for this crime.
He appealed to the Higher Administrative Court, which has now decided that the plaintiff, from the Syrian province of Hasaka, is not eligible for refugee status. The court ruled that he was not personally in danger due to the situation in Syria. Additionally, the court stated that his criminal activities make him ineligible for protection.
If a German court deems Syria safe, the same standard could potentially be applied in the UK. This ruling could have profound implications for Syrians seeking asylum in the UK, potentially leading to their deportation. However, it seems unlikely that this will happen given the Labour Party’s and Civil Service’s intentions to increase immigration in the country. It’s worth noting that this significant development has not been widely reported in the UK.
