Two stories from last week illustrate why Britain should leave the European Convention on Human Rights (ECHR). These cases highlight the misuse of the ‘right to a family life’ provision under Article 8 of the ECHR, which is being exploited by criminals to avoid deportation.
The first story covers an Albanian criminal who, despite being caught attempting to sneak into the UK three times, has now successfully avoided deportation after succeeding on his fourth attempt. This blatant disregard for the law is a slap in the face of justice.
Erind Koka, 33, avoided deportation to Albania because he had served less than a year in prison for producing a class B drug—cannabis.
He argued that sending him back to his home country would violate his rights to family life under Article 8 of the European Convention on Human Rights, as he has a daughter and a partner in the UK. The judges determined that Koka’s offences “fell significantly short of… serious harm.”
The Albanian man initially attempted to enter the UK on a passenger plane using false documents. He was denied entry and deported to Finland. However, just seven months later, he was discovered hiding in a trailer in Dunkirk. In September 2018, he was found concealed in a camper van in Coquelles and was subsequently removed by the French authorities.
On October 3, 2019, he eventually managed to enter the UK illegally by hiding in a lorry. In response to the deportation order, Koka initially sought refugee status but later withdrew that request. Instead, he claimed the right to remain in the country, arguing that his deportation would violate his right to a family life under Article 8 of the European Convention on Human Rights.
The second case involves a romance fraudster who deceived women into paying him nearly £200,000. He has been spared deportation after a judge determined that the healthcare system in his home country of Nigeria would not be able to meet the medical needs of his wife and children.
Emmanuel Jack, 35, was sentenced to three years in prison in 2014 after he posed as an architect on dating websites, tricking six vulnerable women into paying him a total of £186,000. The emotional and financial toll on these women is devastating.
In 2022, the Home Office decided that he should be deported back to Nigeria, the country he left with his parents when he was 10 years old. In response, Jack launched a legal campaign to remain in the UK. An immigration and asylum tribunal in London ruled in his favour, determining that deportation would be unduly harsh on Mr. Jack’s British wife and children, who have complex medical issues and depend on his care.
Tribunal judges Victor Rae-Reeves and Luke Bulpitt were informed that the individual’s wife has medical issues related to her pregnancy. Their 18-month-old son, who was born prematurely, has significant developmental challenges that necessitate close supervision and specialised care. Additionally, the couple’s six-year-old daughter is experiencing problems with her eyesight, as reported to the tribunal.
The tribunal learned that Mr. Jack’s wife has a 16-year-old daughter from a previous relationship, for whom Mr. Jack also provides care. In a letter, the daughter described the “huge role” Mr. Jack plays in her life, stating that “the family would fall apart without him.”
The judges noted, “We have found that the wife and two children are all receiving long-term care for serious medical conditions.”
This situation of refusing to deport because deportation would interfere with the ‘right to a family life’ is not justifiable. Imagine if anyone who committed a heinous and despicable crime argued that the courts should not send them to jail because it would interfere with their ‘right to a family life’. It’s a mockery of justice.
Real change will only happen if Britain abolishes its current human rights legislation. The first step in this process is withdrawing from the European Convention on Human Rights (ECHR). Unfortunately, none of the three main political parties will address this issue, leaving the British Democrats, a party advocating for stricter immigration policies, as the only viable alternative.
