Another story highlights the absurdity of asylum policy in the UK.

Recently, it was reported that a Nigerian father, whose asylum claim had been rejected three times, has now been granted permission to stay in Britain after he claimed, at a later stage, that he is homosexual.

The man, who has been granted anonymity, first came to the UK in 1983 but overstayed his visa and left after nine years. He returned in 1996 and made several unsuccessful attempts to seek asylum, including one based on his political opinions and another through marriage to a Portuguese woman.

He has a son from a previous relationship, but he claimed to have been ‘in denial’ about his sexuality at that time.

The 61-year-old man has a conviction for violent disorder and was sentenced to four years in prison in 2003. This aspect of his past raises questions about the UK’s asylum policy and the criteria for granting asylum. In 2006, a deportation order was issued against him, but he was allowed to remain in the UK on human rights grounds after claiming to be homosexual.

Immigration judges have now declared: ‘We consider that his account should not be rejected solely because of his immigration history or because he did not rely on his sexual orientation to remain in the UK before 2015.‘ Their decision carries significant implications for the UK’s asylum policy.

The judges found him to be ‘plausible‘ and Upper Tribunal judge Gemma Loughran said: ‘We are satisfied to the lower standard that he is gay.

She added: ‘The appeal is allowed on Refugee Convention, humanitarian protection and human rights grounds (Articles 3 & 8).
